Welcome to Tokyo Trends (the "Store"). These Terms and Conditions ("Agreement") govern your use of our website and services. By accessing or using the Site, you acknowledge that you have read, understood, and agreed to be bound by this Agreement and our Privacy Policy. We reserve the right to update or modify these terms at any time without prior notice.

2. Use of Site

You represent that you are at least 18 years old or visiting the Site under the supervision of a parent or guardian. We grant you a limited, revocable, and non-exclusive license to access the Site for personal shopping only. You shall not:

4. Intellectual Property (IP) Policy

All text, graphics, button icons, logos, and images (collectively, "Content") belong exclusively to Tokyo Trends or its content suppliers (including Bandai, Blokees, etc.). IP Infringement: If you believe that your intellectual property rights have been infringed, please provide our agent with:

  1. A description of the allegedly infringing work.
  2. The specific URL of the item on our Site.
  3. Your contact information (address, telephone number, and email).
  4. A statement made under penalty of perjury that the information provided is accurate.

5. Reviews, Comments, and Submissions

Except as otherwise provided, anything you submit to the Site (reviews, comments, ideas) will be treated as non-confidential and non-proprietary. By posting, you grant Tokyo Trends a royalty-free, worldwide, perpetual, and transferable right to use, copy, and adapt such submissions for any purpose.

6. Pricing and Currency

All prices are displayed in Australian Dollars (AUD) and include GST where applicable. Prices for products are subject to change without notice. While we strive for accuracy, typographical errors (including pricing errors) may occur. In such cases, we reserve the right to cancel any orders placed for the incorrectly priced item.

7. Order Acceptance and Cancellation

We reserve the right to refuse or cancel any order for reasons including but not limited to: product availability, errors in pricing, or suspected fraud. Order Modification: Once an order is packed or shipped, it cannot be canceled or changed.

8. Loyalty Points and Store Credits

Tokyo Trends may, at its sole discretion, issue loyalty points or store credits as part of promotional programs.

  • Nature of Credits: Store credits and loyalty points are promotional, have no cash value, are non-transferable, and cannot be exchanged for cash. > * Usage: These rewards may only be used for purchases on the Site. Points must be redeemed for vouchers or credits via our onsite widget before being applied at checkout.
  • Refunds: If an order paid with store credit is returned or cancelled, the refund will be issued back as store credit and not as a cash refund.
  • Expiration & Forfeiture: We reserve the right to modify, cancel, or expire points/credits in cases of suspected fraud, account inactivity, or termination of the loyalty program.

9. Click and Collect Policy (Emporium Melbourne)

To prevent credit card fraud, all 'Local Pickup' orders must adhere to the following:

  • Identification: You must present the Order Confirmation, the Physical Credit Card used for payment, and a Photo ID matching the cardholder's name.
  • Refusal: We reserve the right to refuse collection if the above requirements are not met. Refunds for canceled pickup orders may take 3-10 business days.

10. Shipping, Risk, and Restocking Fees

  • Risk of Loss: Delivery is handled by third-party carriers (e.g., Australia Post). While we assist in dispute resolution, risk passes according to Australian Consumer Law.
  • Restocking Fee: Any delivery returned to us due to an incorrect address or failure to collect from the post office will incur a 40% restocking fee based on the total purchase amount.

11. Limitation of Liability

To the maximum extent permitted by law, Tokyo Trends shall not be liable for any indirect, incidental, or consequential damages arising from the use of this Site or the purchase of products.

12. Customer Code of Conduct

We maintain a zero-tolerance policy for aggressive or abusive behavior towards our staff, whether online or at our Emporium Melbourne store. Such behavior will result in the immediate termination of service and potential banning from future purchases.

13. Governing Law and Arbitration

This Agreement shall be governed by and construed under the laws of Victoria, Australia. Any disputes that cannot be settled amicably within 30 days shall be referred to the exclusive jurisdiction of the courts of Victoria or the Victorian Civil and Administrative Tribunal (VCAT).
